Terms of Service for AtlasFlow

Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the services provided by AtlasFlow (“us”, “we”, or “our”). Your access to and use of the services is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all users, visitors, and others who access or use our services.

By accessing or using our services, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access or use our services.

  1. Services

We provide website design, development, software solutions, and email plans. By using our services, you agree to comply with all applicable laws and regulations in connection with your use of our services.

  1. Accounts

When you create an account with us, you must provide accurate and complete information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.

You are responsible for safeguarding the password that you use to access our services and for any activities or actions under your password. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorised use of your account.

  1. Intellectual Property

All content, including but not limited to text, graphics, logos, images, software, and other material provided by us or our licensors, is the property of AtlasFlow or its licensors and is protected by applicable copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, and revocable licence to use our services for your personal or internal business purposes only. You may not reproduce, modify, distribute, or otherwise exploit our content or services without our prior written consent.

  1. User Content

You are solely responsible for any content, including but not limited to text, images, and other materials, that you submit, post, or otherwise provide through our services (“User Content”). By providing User Content, you represent and warrant that you have all necessary rights, licences, and permissions to do so, and that your User Content does not infringe or violate any third party’s intellectual property, privacy, or other rights.

By submitting User Content, you grant us a non-exclusive, royalty-free, worldwide, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content in any media, including for promotional purposes.

  1. Prohibited Activities

You agree not to engage in any activities that:

a. Violate any applicable laws or regulations. b. Infringe or violate the intellectual property, privacy, or other rights of any third party. c. Are defamatory, obscene, offensive, harmful, or otherwise objectionable. d. Involve the use of our services for any illegal or unauthorised purpose. e. Interfere with or disrupt the operation of our services or the servers or networks used to provide our services. f. Attempt to gain unauthorised access to our services or the accounts, systems, or networks of others.

  1. Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use our services will immediately cease.

  1. Limitation of Liability

In no event shall AtlasFlow, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses

  1. Prohibited Website and Software Categories

a. Tobacco and Related Products: We will not create websites or software that promote the sale or use of tobacco or nicotine products and related paraphernalia unless they are cessation products. This includes any delivery devices such as electronic cigarettes, vaporizers, or any other products that simulate smoking or are designed for use with tobacco or nicotine products.

b. Unsafe Substances: We will not create websites or software that promote the sale or use of illicit or recreational drugs, or other unsafe substances, products, or supplements, as determined by AtlasFlow at its sole discretion.

c. Weapons, Ammunition, or Explosives: We will not create websites or software that promote the sale or use of weapons, ammunition, or explosives. This includes any weapon modification accessories.

d. Adult Products or Services: We will not create websites or software that promote the sale or use of adult products or services. Websites promoting sexual and reproductive health products or services, like contraception and family planning, must be targeted to people 18 years or older and must not focus on sexual pleasure.

e. Adult Content: We will not create websites or software that contain adult content. This includes nudity, depictions of people in explicit or suggestive positions, or activities that are overly suggestive or sexually provocative.

Websites that assert or imply the ability to meet someone, connect with them, or view content created by them must not be positioned in a sexual way or with an intent to sexualize the person featured in the content.

f. Third-Party Infringement: We will not create websites or software that contain content that infringes upon or violates the intellectual property rights of any third party, including copyright, trademark, or other legal rights. This includes, but is not limited to, the promotion or sale of counterfeit goods, such as products that copy the trademark (name or logo) and/or distinctive features of another company’s products to imitate a genuine product.

g. Sensational Content: We will not create websites or software that contain shocking, sensational, or excessively violent content.

  1. Subscription Cancellation

Customers may cancel their subscription at any time based on their request or directly from the account management section of our website. To cancel a subscription through a request, please contact our customer support team using the contact information provided on our website. Upon cancellation, access to any subscription-based services will be terminated, and any applicable fees or charges incurred up to the cancellation date will remain your responsibility.

Please note that some services may be subject to additional terms and conditions regarding cancellation, which will be provided to you when you sign up for the respective service. It is your responsibility to review and understand these additional terms and conditions before using the service.

  1. Refunds

Customers are eligible for a refund under the following conditions:

a. If the website has not been created yet and the domain has not been registered, customers can request a full refund.

b. If we have registered a domain on the customer’s behalf and started the website creation process, customers will not be eligible for a refund for the first billing cycle. In this case, customers may refer to Term 9 and cancel their subscription to avoid further charges after the first billing cycle.

c. If we have not registered a domain on the customer’s behalf and have not started the website creation process, customers can request a full refund.

To request a refund, please contact our customer support team using the contact information provided on our website. Refunds will be processed in accordance with our refund policy and any applicable laws and regulations.

By using our services, you agree to comply with our refund policy and acknowledge that failure to do so may result in the denial of your refund request.
